ICCS™ Certification Labeling

 

ICCS™ TERMS & CONDITIONS - Web Sites

International Content Certification Standard™, (collectively, "ICCS™") is provided by CSI, (collectively "CSI™"). Your use of the ICCS Certification, licensed to your web site is subject to the following terms and conditions. Your use of the ICCS Certification constitutes acceptance of these terms. 

The following terms and conditions are regarding the licensing of service marks and/or HTML statements owned by  ChildSafe International™, hereafter to be referred to as CSI™ including, but not limited to certification under the International Content Certification Standard™, hereafter referred to as ICCS™.

By your choosing to bare the ICCS™ label (meta-tag) and/or logo/HTML statement on your web site, or with your product(s) or service(s), you agree to the following  terms and conditions set forth by CSI™ :

  1. CSI shall not be liable for any direct, incidental, consequential, indirect, or punitive damages arising out of your access to, or use of CSI and/or ICCS marks, logos, meta-tags, or HTML statements.

  2. You acknowledge the validity of the ICCS marks, and that CSI™ has established significant rights of condition therein. You agree not to impair the title, rights and/or interest of CSI™ in the ICCS™ marks which are used under licensing of CSI™, including the label (meta-tag), the acronym and full name of the organization and the ICCS/CSI™ logos. You will not make any claim to, apply to register, or register the label, any ICCS™ mark or any confusingly similar marks. All use of the label and other ICCS™ marks shall remain solely to authorized usage approved by terms and conditions set forth by CSI™.

    • When the ICCS™ application is submitted, CSI™ will send a label (meta-tag), and an HTML statement via email which must be placed as instructed.

    • By submitting the registration and applying the label (meta-tag) and HTML statement as instructed you are granted a license to use the label (meta-tag) for the content specified.

     

    • If any of following conditions is not met, the license is invalid and CSI™ can remove the your entry from our database of ICCS Certified web sites, products, and services.

    • .

    • By clicking "yes" on the ICCS™ Certification Application, You agree to comply with all instructions for the use of the label (meta-tag) and HTML statement given in the registration process according to all terms and conditions set forth in this document and set forth by CSI™.

    • All information submitted through the registration must be accurate, true and complete.

    • The label (meta-tag) and HTML statement must be present as instructed and correspond to the entry in the database.

    • The label (meta-tag)  must be consistent at all times with the content it described in the meta-tag.

    • The label (meta-tag) can only be changed submitting a completely new application and creating a new matching entry in database listing.

    • CSI™ may perform automated and manual checks of the label (meta-tag) and content at any time.

    • Without a valid license the use of  labels, CSI™, and ICCS™ marks must be discontinued and no confusingly similar mark and/or name can be used.

    • If CSI™ revokes a license because of misrepresentation of content, notification will be sent to the e-mail address which is listed in the ICCS Certification application. If the situation is not remedied within one week after such notification, CSI™ reserves the right to take appropriate action including but not limited to, making the misrepresentation known through lists, web-postings and notifications to the press.

    • You hereby indemnify and hold CSI™ harmless from any claims, suits, losses or damages (including reasonable legal fees incurred by CSI™), arising as a result of breach of this agreement or any other action taken by you in connection with any services, labeled site, misrepresentation, or violation of the ICCS certification application.

    • The use of the label (meta-tag) is entirely voluntary, and you enter into this agreement without any representation or warranty of any kind being made by CSI™ hereunder. The occurrence and/or results of any review, evaluation, or other proceedings conducted by or for CSI™ with respect to the label (meta-tag) or HTML statement for the site does not constitute any representation or warranty by or on behalf of CSI™, including any representation that the label (meta-tag) and/or HTML statement is appropriate for the site. Moreover, these occurrences and/or results shall not give rise to any liability or obligations on the part of CSI™, or any rights of reliance by or for you or any third party, nor otherwise be deemed or construed as being for the benefit of you or any third party. CSI™ does not warrant or guarantee that the label and or HTML statement will not infringe the trademark, service mark, trade name, copyright, or other intellectual property rights of any third party.

    • Upon transfer of site responsibility to others, you will notify the successor that the use of the label (meta-tag) and/or HTML statement is subject to these terms and conditions, and that continued use of the ICCS™ label (meta-tag) and/or HTML statement requires re-labeling. Unless so agreed, you will take steps to remove the label (meta-tag) and/or HTML statement as well as the ICCS™ Certified web site, product, or service database entry through notification to CSI™. The license gives no right to sub-license any of the rights granted herein.

    • All notices, claims, requests, and demands to CSI™ shall be made in writing by registered or certified mail with reply postage prepaid to:

    • This agreement shall be governed by the laws of the State of New York and subject to the exclusive jurisdiction of the courts of the State of New York.

    • The trademarks, logos, and service marks (collectively the "Trademarks , meta-tags, and logos") displayed on this Web Site are registered and unregistered trademarks of CSI, its affiliates and others. Nothing contained in the meta-tags, logos, or HTML statement should be construed as granting, by implication, or otherwise, any license or right to use any Trademark displayed  without the written permission of CSI or such third party that may own the Trademark displayed. Your misuse of the Trademarks displayed, or any other content on CSI Web Site, except as provided herein, is strictly prohibited.
